Evidence not in Hasan's favor
Chad Groening - OneNewsNow - 10/13/2010 4:40:00 AMA senior Pentagon advisor believes the government has overwhelming evidence to convict the Muslim Army doctor accused in the November 5 shooting at Fort Hood, Texas.
After defense attorneys asked for almost a month-long delay, the Article 32 hearing in the case has been adjourned until Wednesday. Major Nidal Malik Hasan is charged with premeditated murder and attempted premeditated murder in last year's attack at the Texas military post, in which 13 people and an unborn baby were killed and 32 others were wounded.
The proceeding was scheduled to begin Tuesday at Fort Hood to determine whether the Army psychiatrist should go to trial, but defense attorneys have asked that the hearing be put off until November 8, and they have requested a day to explain the appeal in writing.
Lt. Col. Bob Maginnis (USA-Ret.) believes there is overwhelming evidence against Hasan.
"Any prudent person that's seen just the media reports is going to draw the conclusion that there's...overwhelming evidence that he should go to trial," Maginnis decides. "Now the question is whether or not there will be a deal struck between the prosecutor and his defense attorney. Keep in mind the military does have the death penalty, though it doesn't carry it out very often. And of course there may be an attempt to have him psychiatrically evaluated to determine whether or not he should stand trial."
The Army strategist adds that Hasan's defense attorney may try to argue that his client is mentally unfit for a court martial.
